    • The law does not require notarization of a living trust. A living trust is legal in most states without the signature and seal of a notary but it is prudent to have a living trust notarized. Some jurisdictions may require notarization of trust documents.

    What is the Benefit of Notarizing?

    • A notarized living trust will overcome challenges to the authenticity of signatures on the trust documents. The notary signature and seal declare the document and signatures to be genuine.


    • Witnesses lend credibility to any legal document signing. Two witnesses are usually sufficient. Witnesses must be present at the time documents are signed.
